The UK’s High Court announce judgement Day

As many readers would know the UK, like Australia are conducting a test case on whether UK policies respond to claims arising from COVID-19.

The court has stated that judgment will be handed down at 10:30am GMT 8:30pm AEST on Tuesday 15 September 2020.

While this will an interesting day next Tuesday with a lot of nervous Insureds and insurers looking on it will not set a precedent for Australia where different issues are under review.

To learn more about the background and the submissions made please visit the UK’s Financial Control Authority (“FCA”) website.

Meanwhile it was not good news for Insured’s in Florida where a court found that the US based wording they had did not cover disruption arising from COVID-19.

It should be clearly understood that none of these cases should give hope or despair to any one in Australia. The policies in all three jurisdictions are different and the issues before the courts in each location are different and will be heard on their own merits.

I appreciate there are some advocates attempting to cash in on this matter and I think it best to allow the test cases to be heard in Australia and then formulate a decision on how best to proceed.
